Terms
Terms of Use
1. Provider and scope
These Terms apply to use of the Hyse iOS app and related online services by consumers and other users.
Provider: Lukas Hammer (private individual), Falkenstraße 12, 01067 Dresden, Germany, email: hyse@minipliy.net.
Different terms apply only if expressly agreed.
2. What Hyse provides
Hyse helps users personally record and review foods, recipes, meals, calories, nutrition, water, workout data and self-defined goals. Depending on permissions, Apple Health data may be used for displays and calculations or data may be written to Apple Health. Hyse may also provide local reminders, optional push notifications and local text logging for foods. Photo analysis and transmission to Google Gemini are currently disabled. Suggestions are estimates and must be reviewed before adding them to the diary.
Hyse is not a medical device and does not replace medical diagnosis, nutrition advice or treatment. Displayed values, calculations and public product data may be incomplete, outdated or incorrect. Discuss health decisions with qualified professionals.
3. Requirements
- A compatible Apple device, supported iOS version and—where online functions are used—an internet connection are required.
- Some features require voluntary permissions, such as camera or Health access.
- Hyse is intended for users aged 16 or older. This also applies to local use without an account.
- Anyone lacking or having limited legal capacity may use Hyse only as permitted by law and, where required, with legal-representative consent.
- Complete and accurate information is required for account features.
4. Guest use and accounts
Core features may be available locally without an account. Synchronisation and other online services may require an account. Where offered, sign-in may use email and password, Google or Apple.
You must keep credentials confidential, protect your devices appropriately and report suspected misuse immediately to hyse@minipliy.net. Actions through an account are attributed to its owner where the owner is responsible for them.
There is no entitlement to a specific sign-in provider. Google and Apple sign-in are also subject to that provider's terms.
5. Permitted and prohibited use
Hyse may be used only under these Terms and applicable law. In particular, you must not:
- use Hyse unlawfully, fraudulently or abusively;
- access another person's account, system or data without authorisation;
- circumvent security, access controls or usage restrictions;
- cause automated overload, disruption or malware, scrape data or reverse engineer except where mandatory law permits it;
- transmit unlawful content or infringe privacy, data-protection, copyright or other third-party rights;
- present misleading health information as professional advice by reference to Hyse.
You remain responsible for the legality and accuracy of food and recipe data you enter.
6. Product and nutrition data
Product information may come from Open Food Facts or user input. Hyse does not fully verify it and gives no guarantee of accuracy, completeness or currency. Product packaging, manufacturer information and individual medical advice remain decisive.
7. Availability and changes
Hyse is operated with reasonable care, but uninterrupted and error-free availability is not guaranteed. Maintenance, security measures, technical problems, force majeure and changes to external services may temporarily limit functions.
Functions may be developed, modified or discontinued with appropriate regard for users' legitimate interests. Material adverse changes will be announced in advance where required and practicable.
8. Rights in Hyse
Hyse software, design, trademarks, texts and other elements are legally protected. For the duration of permitted use, you receive a simple, non-transferable and non-sublicensable right to use the app for personal purposes. Rights in your own entries remain yours; you grant Hyse the rights needed to store, synchronise and display them technically.
9. Liability
The provider has unlimited liability in cases of intent and gross negligence, culpable injury to life, body or health, and in all cases of mandatory statutory liability.
In the event of a slightly negligent breach of an essential contractual obligation, liability is limited to the loss that was foreseeable at the time the contract was concluded and is typical for the contract. In all other respects, liability for slight negligence is excluded to the extent permitted by law.
Hyse is intended solely for personal documentation and general information. Displayed or calculated information, particularly concerning calories, nutritional values, energy requirements, nutrition and comparable values, may be estimates and may differ from actual values. To the extent permitted by law, the provider gives no warranty as to the accuracy, completeness or suitability of this information for a particular purpose.
Hyse does not provide medical advice, advice in nutritional medicine, or any other professional advice and is not intended for the diagnosis, treatment or prevention of disease. Any decisions based on data entered by users, calculated by Hyse or provided by third parties are the user's sole responsibility.
Where Hyse uses data or functions from third parties, in particular platform, health or food databases, the provider assumes no responsibility, to the extent permitted by law, for the accuracy, completeness or availability of the data and services provided by those third parties.
The foregoing limitations of liability apply only to the extent permitted by law. Mandatory statutory rights remain unaffected.
10. Termination and account deletion
You may stop using Hyse at any time. Signed-in users can permanently delete their account and synchronised data in Hyse settings or request deletion at hyse@minipliy.net. Local data can be deleted separately in the app or by uninstalling it.
The provider may suspend or terminate accounts for material or repeated breaches. Users will generally be allowed to respond before permanent suspension unless security, legal duties or the seriousness of the breach prevent this.
See the Privacy Policy for deletion details.
11. Changes to these Terms
These Terms may be changed where legal, technical or functional developments require it. Material changes will be communicated appropriately. Changes to existing contractual relationships apply only as permitted by law.
12. Governing law and dispute resolution
The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rules of the country where a consumer habitually resides remain unaffected.
Statutory venues apply to consumers. Where a venue agreement is legally permitted, Dresden is the venue.
The provider is neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board.
13. Final provisions and contact
If any provision is invalid, the remaining provisions remain unaffected and the statutory rule replaces the invalid provision. Questions may be sent to hyse@minipliy.net.
See the Hyse Privacy Policy.
